Mobile Terms of Service

1. Program Description

4xSolar LLC ("4xSolar," "we," "us," or "our") offers a mobile messaging program (the "Program") to send you promotional and transactional SMS text messages related to our products, services, orders, shipments, and events. By opting into the Program, you agree to these Mobile Terms of Service and consent to receive automated marketing text messages from us at the mobile phone number you provided.

2. Consent to Receive Text Messages

By providing your mobile phone number and opting in through any 4xSolar signup form, checkout, tradeshow QR code, or SMS keyword response (e.g., replying to a "YES" prompt), you expressly consent to receive automated marketing and transactional text messages from 4xSolar at the mobile phone number you provided.

Consent to receive marketing text messages is not a condition of purchase.

3. Message Frequency

Message frequency varies. You may receive up to 15 promotional messages per month, in addition to transactional messages related to your orders, shipments, or events you have opted into.

4. Message and Data Rates

Message and data rates may apply. 4xSolar does not charge you a fee to send or receive SMS messages, but standard message and data rates from your mobile carrier will apply. Contact your carrier for details about your specific plan.

5. Opting Out

You may opt out of the Program at any time by replying STOP, UNSUBSCRIBE, CANCEL, END, or QUIT to any text message from 4xSolar. After you opt out, you will receive one final confirmation message and will no longer receive text messages from 4xSolar unless you re-subscribe.

7. Supported Carriers

We support all major U.S. carriers, including but not limited to AT&T, Verizon, T-Mobile, Sprint, U.S. Cellular, Boost Mobile, Cricket, and MetroPCS. Carriers are not liable for delayed or undelivered messages.

8. Privacy

Your privacy is important to us. Information you provide when you sign up for the Program is used in accordance with our Privacy Policy. We will not share, sell, or rent your mobile phone number or opt-in data to third parties for their marketing purposes. Phone numbers collected for SMS marketing are not shared with third parties for their marketing purposes at any time.

9. Eligibility

To participate in the Program, you must be at least 18 years of age (or the age of majority in your jurisdiction) and a legal resident of the United States. By opting in, you represent and warrant that you meet these requirements and that you are the account holder or authorized user of the mobile phone number provided.

10. Program Modifications and Termination

4xSolar reserves the right to modify, suspend, or terminate the Program, in whole or in part, at any time without notice. We may also update these Mobile Terms of Service from time to time. Continued participation in the Program after any such changes constitutes your acceptance of the updated Mobile Terms.

11. Disclaimer of Warranties

The Program is provided on an "as is" and "as available" basis. 4xSolar makes no warranties, express or implied, regarding the Program, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement.

12. Limitation of Liability

To the maximum extent permitted by law, 4xSolar shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your participation in the Program, including but not limited to lost profits, lost data, or business interruption.

13. Governing Law and Dispute Resolution

These Mobile Terms of Service are governed by the laws of the State of Arizona, without regard to conflict of law principles. Any dispute arising out of or related to the Program shall be resolved through binding arbitration in Pima County, Arizona, in accordance with the rules of the American Arbitration Association.
